You bought a washing machine that broke in 3 months. Your flight was cancelled and the airline won't refund. An e-commerce platform delivered a fake product. You had dental surgery that went wrong. In all these situations, you have powerful legal rights as a consumer — and you can fight back without a lawyer, from your phone.
The Consumer Protection Act, 2019 is one of the strongest consumer laws in Asia. It covers products AND services, includes e-commerce and online transactions, and can result in compensation, replacement, or full refunds — sometimes within 90 days.
Your 6 Core Consumer Rights
- Right to Safety — Protection from products/services that are hazardous to life or property
- Right to Information — Know the quality, quantity, price, and ingredients of what you buy
- Right to Choose — Access to variety of products at competitive prices
- Right to Be Heard — Your complaint must be considered by businesses and consumer courts
- Right to Seek Redressal — Get compensation, replacement, or refund for unfair trade practices
- Right to Consumer Education — Know your rights and how to exercise them
What Counts as a Consumer Complaint?
You can file a complaint for:
- Defective product (hardware fault, expired product sold as fresh)
- Deficient services (hospital, hospital, contractor, school, bank)
- Overcharging or charging more than MRP
- Misleading advertisement
- Unfair trade practice (fake discounts, hidden charges)
- Refusing to honour warranty or guarantee
- E-commerce issues — fake product, wrong product, non-delivery, refund not given
Step 1: Try Resolution Directly First
Before going to consumer court, always try resolution directly:
- Contact customer care (keep records of every call/email)
- Send a formal email/letter demanding resolution within 15 days
- Escalate to senior management or nodal officer
Why this matters: Showing you tried resolution makes your complaint stronger in consumer court.
Step 2: File on National Consumer Helpline
If direct resolution fails, call 1800-11-4000 or visit consumerhelpline.gov.in. This is a free grievance platform that contacts the company on your behalf. Many complaints (especially e-commerce, telecom, insurance) are resolved here within 15–30 days without going to court.
Step 3: File a Consumer Court Case (E-Daakhil)
If the helpline doesn't work, file a formal case at Consumer Dispute Redressal Commission. Now you can do this 100% online via edaakhil.nic.in:
- Register on edaakhil.nic.in with Aadhaar or email
- Click "File a Complaint" — fill in party details (you and the company)
- State your complaint clearly — what happened, what you lost, what you want
- Upload documents (bills, screenshots, emails, warranty cards, medical records)
- Pay the filing fee (see table below)
- Receive your case number by email
Consumer Court Jurisdiction (Which Court to Approach)
| Claim Amount | Court | Filing Fee |
|---|---|---|
| Up to ₹50 lakh | District Consumer Commission | ₹200–₹2,000 |
| ₹50 lakh – ₹2 crore | State Consumer Commission | ₹2,000–₹4,000 |
| Above ₹2 crore | National Consumer Commission (Delhi) | ₹5,000+ |
Note: You do NOT need a lawyer in consumer court. The process is designed for consumers to represent themselves (pro se).
