What Counts as a Consumer Complaint?

You can file a complaint for:

  • Defective product (hardware fault, expired product sold as fresh)
  • Deficient services (hospital, hospital, contractor, school, bank)
  • Overcharging or charging more than MRP
  • Misleading advertisement
  • Unfair trade practice (fake discounts, hidden charges)
  • Refusing to honour warranty or guarantee
  • E-commerce issues — fake product, wrong product, non-delivery, refund not given

Step 1: Try Resolution Directly First

Before going to consumer court, always try resolution directly:

  1. Contact customer care (keep records of every call/email)
  2. Send a formal email/letter demanding resolution within 15 days
  3. Escalate to senior management or nodal officer

Why this matters: Showing you tried resolution makes your complaint stronger in consumer court.

Step 2: File on National Consumer Helpline

If direct resolution fails, call 1800-11-4000 or visit consumerhelpline.gov.in. This is a free grievance platform that contacts the company on your behalf. Many complaints (especially e-commerce, telecom, insurance) are resolved here within 15–30 days without going to court.

Step 3: File a Consumer Court Case (E-Daakhil)

If the helpline doesn't work, file a formal case at Consumer Dispute Redressal Commission. Now you can do this 100% online via edaakhil.nic.in:

  1. Register on edaakhil.nic.in with Aadhaar or email
  2. Click "File a Complaint" — fill in party details (you and the company)
  3. State your complaint clearly — what happened, what you lost, what you want
  4. Upload documents (bills, screenshots, emails, warranty cards, medical records)
  5. Pay the filing fee (see table below)
  6. Receive your case number by email

Can I file a consumer complaint against a doctor or hospital?
Yes. Medical services are included under the Consumer Protection Act, 2019. If a doctor's negligence or hospital's deficient service caused you harm, you can file a consumer complaint. Keep your medical records, prescriptions, bills, and diagnostic reports. Complaints against doctors can also be filed with the State Medical Council for professional misconduct.
How long does a consumer court case take?
The Consumer Protection Act mandates disposal of cases within 90 days if no lab testing is required, or 150 days with lab testing. However, in practice, cases often take 6–18 months due to backlog. The E-Daakhil portal and virtual hearings have significantly sped up the process since 2020. Simple cases with clear evidence are resolved faster.
Is there a time limit for filing a consumer complaint?
Yes — you must file within 2 years from the date the cause of complaint arose (e.g., date of purchase for a defective product, or date the service failure occurred). Beyond 2 years, you need to apply for condonation of delay with valid reasons. Don't delay — keep your bills and file promptly if things go wrong.
Can I get compensation for mental agony from consumer court?
Yes. Consumer courts regularly award compensation for mental agony, harassment, and inconvenience caused by deficient service — in addition to the actual loss amount. The amount varies based on the severity of the case. Some landmark cases have awarded lakhs in mental agony compensation against airlines, hospitals, and builders.
I bought something online and it turned out fake. What can I do?
E-commerce sellers are covered under the Consumer Protection Act. Steps: (1) Don't discard packaging — photograph everything, (2) Report immediately on the platform's app/website, (3) File on consumerhelpline.gov.in, (4) File a complaint on the Grievance Officer email of the e-commerce company (they are required to have one), (5) Escalate to consumer court if not resolved.
